Waiver, Release of Liability, and Assumption of Risk

Please read this carefully. It affects your legal rights. By checking the box to accept this Waiver and starting a membership, you agree to its terms.

1. Parties

This Waiver is an agreement between you ("you" or "Participant") and Xu DaRocha, an individual doing business as Xu DaRocha Healing Art and Wu Ji School (together, "WuJi School"), together with her instructors, employees, contractors, and agents (together, the "Released Parties").

2. The activities

WuJi School offers recorded and live-recorded instruction in chi gong, tai chi, movement, breathwork, and meditation (the "Activities"). You practice on your own, in a location you choose, without an instructor present to observe or correct you.

3. Risks

You understand the Activities involve risks, some of which cannot be eliminated. They include, but are not limited to:

  • Muscle strain, joint injury, and other physical injury
  • Dizziness, lightheadedness, tingling, or fainting, especially during breathwork or breath retention
  • Falls and injuries from your surroundings
  • Aggravation of existing medical conditions
  • Strong emotional experiences, including anxiety, grief, disorientation, or the surfacing of difficult memories
  • In rare cases, serious psychological effects for people with certain conditions or histories

4. Your health

You confirm that:

  • You are 18 years of age or older.
  • You are physically and mentally able to take part in the Activities, or you have consulted a qualified healthcare provider and received clearance to do so.
  • You do not have psychosis, a psychotic disorder, or any other mental health condition that the Activities could put at risk, and you will stop practicing if that changes.
  • You will consult a healthcare provider before practicing if you are pregnant; have a heart condition, high or low blood pressure, epilepsy or a seizure disorder, glaucoma, or a respiratory condition; have had recent surgery or injury; have a history of psychosis, bipolar disorder, severe trauma, or dissociation; or have any other condition that intensive breathwork or meditation could aggravate.
  • You will tell your healthcare provider about the nature of the Activities, including breathwork, when asking for clearance.

5. Not medical or psychological advice

Xu DaRocha is not a licensed physician, psychologist, or mental health provider. Nothing offered through WuJi School is medical, psychological, or therapeutic advice, diagnosis, or treatment, and it is not a substitute for care from a qualified professional. Do not stop, delay, or change any medical or psychological treatment because of anything you learn here.

The teachings from Xu DaRocha, Xu DaRocha Healing Art, and Wu Ji School are offered for educational and spiritual instruction, not as medical advice. Taoist terms such as "healing," "medicine," or "elixir" are used metaphorically, referring to energetic cultivation rather than medical treatment.

6. Your responsibilities

You agree that you are responsible for your own safety while practicing. In particular, you will:

  • Practice in a safe, uncluttered space where you can sit or lie down if needed.
  • Never practice breathwork while driving, operating machinery, bathing, swimming, or in or near water.
  • Never practice while under the influence of alcohol, cannabis, psychedelics, or any other substance that affects your judgment or physical state.
  • Work within your own limits, modify or skip any exercise that does not feel right, and stop immediately if you feel pain, faintness, shortness of breath, or distress.
  • Seek medical help if you experience symptoms that concern you.

7. Practice guidance

These contemplative and breath-based practices may occasionally evoke strong emotional or psychological responses.

Participation is not recommended: during pregnancy; during periods of significant emotional or psychological vulnerability; participants with relevant physical, medical, or psychological conditions (including trauma history or substance use issues) should seek appropriate professional guidance before participating.

Participation is voluntary, and individuals remain responsible for their own wellbeing during and after the teachings. Participants are encouraged to respect their personal limits and stop when needed.

Daoist internal practices develop gradually. Please approach the exercises gently and patiently. Work at about 60–70% effort rather than maximum intensity. Please maintain a relaxed attitude toward progress. These practices are not competitive or performance-based. Therefore, avoid straining breath, posture, or concentration and if discomfort, dizziness, or emotional distress arises, pause and rest.

If you are following this teaching from a recording rather than a live session, please practise conservatively and follow the above guidance. If you become uncertain about a practice, pause or skip it and seek guidance from the course organiser or a suitably experienced instructor.

Remember: consistency and moderation are more beneficial than intensity. Participants are encouraged to practise with self-awareness, respect their limits, proceed at their own pace and stop when needed.

8. Assumption of risk

You take part in the Activities voluntarily. You knowingly and freely assume all risks of the Activities, both known and unknown, even if they arise from the negligence of the Released Parties.

9. Release of liability

To the fullest extent permitted by law, you release, waive, and discharge the Released Parties from any and all claims, demands, losses, and liability for injury, illness, death, or damage of any kind arising out of or related to your participation in the Activities or your use of WuJi School's content, including claims based on the ordinary negligence of the Released Parties.

This release does not apply to gross negligence or intentional misconduct, or to any claim that cannot be released under applicable law.

10. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, costs, or expenses, including reasonable attorneys' fees, arising from your breach of this Waiver or your participation in the Activities.

11. Binding effect

This Waiver binds you and, to the extent permitted by law, your heirs, executors, administrators, and anyone who might make a claim on your behalf.

12. Governing law

This Waiver is governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California.

13. Severability

If any part of this Waiver is found invalid or unenforceable, that part will be enforced to the maximum extent permitted, and the rest of the Waiver will remain in full effect.

14. Changes

WuJi School may update this Waiver. If it does, you will be asked to accept the new version before continuing to use the Activities.

By accepting, you confirm that you have read this Waiver, understand it, are giving up substantial legal rights, including the right to sue the Released Parties for ordinary negligence, and are signing it freely and voluntarily.
